The modern era of competition law in New Zealand began with the Commerce Act 1986. Since then, a steady and impressive corpus of case law had traversed all the usual major areas of antitrust law: cartels, resale price maintenance, exclusive dealing, tying, group boycotts, monopolization, mergers and acquisitions, exempted sectors, and the role of economic evidence. The author argues that the prevailing worldview held by those in power in Western governments sets bounds for religious intolerance. He explores the degree to which a modern liberal state will allow a counter-cultural community the freedom to live according to its concept of a good life. Specifically, he takes one important group of religionists, "conservative Christians", (essentially theologically conservative, usually Protestant, Christians, who adhere to "traditional" moral values) and investigates how their worldview, attitudes and practices are treated by a state holding to an increasingly antithetical worldview. This important book explores the role of the courts and of various types of commissions in mediating and reinventing historical narratives of colonisation. Belgrave shows how the courts became from 1840 places where different narratives of discovery and conquest, of loss and displacement and of claims to resources and mana were debated. These legal debates were not only between Maori and Pakeha; Maori also used the courts to maintain or reclaim traditional rights between Maori and Maori. From this perspective the Waitangi Tribunal is less radical than is often supposed and is seen to be carrying on a similar function to earlier tribunals and courts in the transformation of historical narratives. Historical Frictions will cover a number of issues, all of which have been before the Waitangi Tribunal, including the Old Land Claims, the Kemp Purchase, confiscation, the Orakei Block, the Whanganui River, fisheries, the Chatham Islands and the Wellington Tenths claim.

This is a contribution to the debate surrounding the Treaty of Waitangi. A central theme is how a revolutionary taking of power by one people over another may be partly legitimated. Wrongs done to those who suffered the take-over must then be redressed with due allowance for new rights and interests that have resulted from it. Part 1 deals with the role of law in actual or threatened revolution, but especially in the revolutionary expansions of Western imperialism. In part 2 the focus is narrowed further: on the British Crown's seizure of power of Aotearoa-New Zealand from 1840, the counter-revolutionary challenges of Maori over the years, the establishment of the separate New Zealand Crown, and the present problems of doing justice to Maori constitutional claims. Developed extensively from the author's earlier writings on law and revolution and on Waitangi matters and indigenous rights, the book is especially for people who study or work in those fields; but it is intended for the general reader also. It aims to advance and to widen current debate, in part by the criticism it offers of the views of some prominent participants.
