Under the guise of Islamic law, the prophet Muhammad's Islam, and the Qur'an, states such as Pakistan, Afghanistan, Egypt, Saudi Arabia, and Bangladesh are using blasphemy laws to suppress freedom of speech. Yet the Prophet never tried or executed anyone for blasphemy, nor does the Qur'an authorize the practice. Asserting that blasphemy laws are neither Islamic nor Qur'anic, Shemeem Burney Abbas traces the evolution of these laws from the Islamic empires that followed the death of the Prophet Muhammad to the present-day Taliban. Her pathfinding study on the shari'a and gender demonstrates that Pakistan's blasphemy laws are the inventions of a military state that manipulates discourse in the name of Islam to exclude minorities, women, free thinkers, and even children from the rights of citizenship. Abbas herself was persecuted under Pakistan's blasphemy laws, so she writes from both personal experience and years of scholarly study. Her analysis exposes the questionable motives behind Pakistan's blasphemy laws, which were resurrected during General Zia-ul-Haq's regime of 1977-1988-motives that encompassed gaining geopolitical control of the region, including Afghanistan, in order to weaken the Soviet Union. Abbas argues that these laws created a state-sponsored "infidel" ideology that now affects global security as militant groups such as the Taliban justify violence against all "infidels" who do not subscribe to their interpretation of Islam. She builds a strong case for the suspension of Pakistan's blasphemy laws and for a return to the Prophet's peaceful vision of social justice.

This study offers a conceptual analysis of gender and human rights under Islamic law, state law and international law, and extends this analysis to a specific examination of the nature of women's rights in the Islamic tradition. It explores the disparity between the theoretical perspective on women's rights and its application to Muslim jurisdictions, determined by elements of cultural practices, socio-economic realities and political expediencies, and uses the example of Pakistan to demonstrate the divergence between the theory and practice of Islamic law in these jurisdictions. It discusses the concept of an emerging "operative" Islamic law, which includes principles of Islamic law, secular codes of law and popular custom and usage. Is the notion of human rights a purely "Western" concept? Is there a human rights discourse in Islam? What is the degree of compatibility or otherwise between the concept of human rights in the Islamic tradition and that viewed from an international legal perspective? Are men and women regarded as being equal in the Islamic legal tradition? Does formal equality always translate into substantive equality? This study aims to answer these and many other questions. The author aims to deconstruct the various intractable notions that exist about gender, human rights, Islam and international law. She establishes a methodology for analyzing complex situations encompassing a variety of disciplines and presents a number of alternative approaches for their greater understanding. The book is based on extensive and in-depth research and provides a wealth of information across a number of fields including human rights, Islamic law, gender and the law, international law and constitutional law. The partitioning of India and the creation of the independent State of Pakistan were consequences of demands for the right of self-determination by the Muslims of British India. Since the creation of Pakistan, however, its constitutional and legal practices have been equivocal, characterised by a failure to acknowledge the existence of 'ethnic' minorities and a reticence to accord internationally recognised rights to indigenous peoples. Even following the secession of East Pakistan, an unfortunate reflection of the lacuna within the constitutional and legal recognition of the rights of indigenous peoples and ethnic minorities, Pakistan's policy makers have continued their strategy of non-recognition and forced assimilation of minority groups. This in-depth study, the first of its kind, examines the issues being faced by the indigenous peoples and ethnic minorities in Pakistan, including their role in the nation's constitutional and legal developments. In its concluding part, it makes a number of recommendations which would satisfy the demands and claims of indigenous peoples and ethnic minorities without compromising the sovereignty of the state. This book will prove to be of interest not only to constitutional lawyers, but also to academics working in the areas of politics, international law and international relations.
