In Palestine, family law is a controversial topic publicly debated by representatives of the state, Sharia establishment, and civil society. Yet to date no such law exists. This book endeavors to determine why by focusing on the conceptualization of gender and analyzing "law in the making" and the shifts in debates (2012-2018). In 2012, a ruling on khul'-divorce was issued by the Sharia Court and was well received by civil society, but when the debate shifted in 2018 to how to "harmonize" international law with Islamic standards, the process came to a standstill. These developments and the various power relations cannot be properly understood without taking into consideration the terminology used and redefined in these debates.

Introducing the Negev-Bedouin land issue from the international indigenous land rights perspective, this comparative study suggests options for the recognition of their land. The book demonstrates that the Bedouin land dispossession, like many indigenous peoples', progressed through several phases that included eviction and displacement, legislation, and judicial decisions that support acts of dispossession and deny the Bedouin's traditional land rights. Examining the Mawat legal doctrine on which the State and the Court rely on to deny Bedouin land rights, this volume introduces the relevant international law protecting indigenous land rights and shows how the limitations of this law prevent any meaningful protection of Bedouin land rights. In the second part of the work, the Aborigines' land in Australia is introduced as an example of indigenous peoples' successful struggle for their traditional land rights. The final chapter analyzes the basic elements of judicial recognition of the land and shows that the basic elements needed for Bedouin land recognition exist in the Israeli legal system. When Yosef Harish was appointed attorney general in 1986, the government expected and even demanded that he order the GSS investigation to be closed - but he insisted on continuing the investigation and on the other hand defended the president's authority to pardon GSS officials. The Beisky Committee recommended that the bank executives be prosecuted for regulating the shares; Harish checked and found that there was no deception in their actions; The High Court intervened, overturned his decision and ordered them to be prosecuted. After a long and expensive legal process - the mountain gave birth to a mouse, they were acquitted and it turned out that Harish was right. In the seven years of his tenure as ombudsman - justice, fairness and law, material considerations, balanced and value-based, and they alone.
