This volume presents the first comprehensive examination of the legal issues surrounding international debt recovery on claims against Iraqi oil and gas. "The attempt in 2004 to draft an interim constitution in Iraq and the effort to enact a permanent one in 2005 were unintended outcomes of the American occupation, which first sought to impose a constitution by its agents. This two-stage constitution-making paradigm, implemented in a wholly unplanned move by the Iraqis and their American sponsors, formed a kind of compromise between the populist-democratic project of Shi'ite clerics and America's external interference. As long as it was used in a coherent and legitimate way, the method held promise. Unfortunately, the logic of external imposition and political exclusion compromised the negotiations. Andrew Arato is the first person to record this historic process and analyze its special problems. He compares the drafting of the Iraqi constitution to similar, externally imposed constitutional revolutions by the United States, especially in Japan and Germany, and identifies the political missteps that contributed to problems of learning and legitimacy. Instead of claiming that the right model of constitution making would have maintained stability in Iraq, Arato focuses on the fragile opportunity for democratization that was strengthened only slightly by the methods used to draft a constitution. Arato contends that this event would have benefited greatly from an overall framework of internationalization, and he argues that a better set of guidelines (rather than the obsolete Hague and Geneva regulations) should be followed in the future. At 12:21 pm, on October 19,2005, Saddam Hussein was let! into the Courtroom of the Iraqi High Tribunal in Baghdad for one 9f the most important and messiest trials in history. For a year, two American law professors had led an elite team of experts who prepared the judges and prosecutors for 'the Mother of all Trials.' Scharf, a former State Department official who helped create the Yugoslavia Tribunal in 1993, and Newton, then a Professor at West Point, would confront such issues as whether the death penalty should apply (the U.K. and U.N. actually opposed it), how to run a fair trial when political and military passions ran so high, and which of Saddam's many crimes should be prosecuted.Newton was in Baghdad in December 2003 when the Tribunal was announced and Saddam was captured. This book chronicles the story of the Kurdish genocide that was not told during the trial of Saddam Hussein.Saddam Hussein's execution for his crimes against Iraq's Shi'a not only brought an end to his reign of oppression, but also to the justice that was to be served to the Iraqi Kurds.The Kurds have continually been under adversity since the end of World War I, when they were denied their own homeland, splitting them into three countries: Turkey, Iran, and Iraq. However, during Saddam's 24-year reign, the Kurds were frequently 'under the knife' of injustice. Between 1987 and 1989, Saddam unleashed genocide, razing over 2,000 villages and murdering at least 50,000 Kurds. As his dictatorship came to an end, the Kurds long-awaited day to hold Saddam responsible for the atrocities against the Kurds had come, only to be sidetracked by the Iraqi High Tribunal, Iraqi government and the U.S. government. While the Shi'a rejoiced in their victory, the Kurds would continue to be left behind. Saddam's death subsequently relinquished all of the charges put forth on him against the Kurds. The world had turned its back on the Kurds in their age of genocide, and now appeared to turn a blind eye to the justice that was denied.
