This book takes a new approach to post-socialist constitutional change in Europe and Eurasia. It views these constitutions as the products of the collapse of Europe's last empire, the Soviet Union. This book therefore seeks to understand these constitutions as more than just post-authoritarian texts, but also as post-colonial ones. This post-colonial paradigm provides a new set of tools for understanding constitutional dynamics in key countries within the European Union as well as the former Soviet republics to the East. In particular, it helps explain democratic backsliding in Central Europe (such as Hungary and Poland), authoritarian resilience in many of the former Soviet republics (including Russia, Belarus, and Kazakhstan) as well as ongoing struggles about national identity in places like Ukraine and Moldova. Partlett and Kupper's application of the post-colonial paradigm to the former Soviet world contributes to our understanding of post-colonial constitutionalism. This book considers the process of legal modernization in Russia from the development of the mechanism of complaints addressed to the authorities from the pre-revolutionary period to today. It analyzes wide-ranging data and sources, collected over 17 years, such as legislation, in-depth interviews, archival materials, original texts, and examples of different methods of complaints in Soviet and contemporary Russia. Being marginal to the legal system and almost invisible for researchers of legal development, the complaint mechanism has functioned as an extremely important way of restoring justice, available to the majority of people in Russia for centuries. It has survived several historical gaps and, in a sense, acts as a thread that stitches together different eras, coexisting with the establishment and modernization of legal institutions, compensating, accompanying, and sometimes substituting for them. The research covers a period of over 100 years, and shows how and why at major historical crossroads, Russia chooses between full-fledged legal modernization and saving the authoritarian social contract between the state and society. The book addresses authoritarian legacies of politically motivated justice and its unwritten practices that have re-emerged in the recent trials related to both political and ordinary criminal charges against prominent opposition leaders in many former Soviet republics. Taking into account that in any country all trials are more or less related to politics, the author differentiates between trials on political issues (political trials that are not necessarily arbitrary) and politicized partisan trials (arbitrary trials against political opponents). The monograph, thus, adopts a broad definition of a political trial, which includes all trials that are related to politicians and political matters such as elections, regime change, activities of parties and other political organizations. The focus lies on a separate group of partisan trials that are politicized (i.e. politically motivated) and which are used by governments to restrain political opposition and dissent. Primarily aimed at legal practitioners such as human rights lawyers, prosecutors, and judges, as well as postgraduates, researchers, teaching assistants and university law professors, readers can gain from the book information that is useful in assessing the interdisciplinary phenomenon of politically motivated criminal justice in transitional and authoritarian post-Soviet republics. The State versus The People provides the first detailed account of the role of revolutionary justice in the early Soviet state. Law has often been dismissed by historians as either unimportant after the October Revolution amid the violence and chaos of civil war, or, in the absence of written codes and independent judges, little more than another means of violence alongside the secret police (Cheka). This is particularly true of the most revolutionary aspect of the new justice system, revolutionary tribunals-courts inspired by the French Revolution and established to target counter-revolutionary enemies. Yet the evidence put forward in this book paints a more complex picture. The Bolsheviks invested a great deal of effort and scarce resources in building an extensive system of tribunals that spread across the country and operated within the military and the transport network. At their peak, hundreds of tribunals heard hundreds of thousands of cases every year. Not all, though, ended in harsh sentences: some were dismissed through lack of evidence; others given a wide range of sentences; and others still, suspended sentences. Instances of early release and amnesty were also common. This book argues that law played a distinct and multi-faceted role for the Bolsheviks. Tribunals, in particular, stood at the intersection between law and violence, offering various advantages to the Bolsheviks by strengthening state control, providing a more effective means of educating the population about counter-revolution, and enabling a more flexible approach to punishing the state's enemies. All of this challenges traditional understandings of the early Soviet state, adding to our knowledge of the civil war and, ultimately, how the Bolsheviks held on to power.
