Addiction is pervasively present within the criminal justice sector, resulting in legal professionals regularly dealing with addicted defendants. Yet addiction is a complex and heterogeneous phenomenon, resulting in controversies regarding its conceptualisation, and thus difficulties in addressing addiction-related crime in court. Over the last decades, addiction has increasingly been conceptualised as a brain disease, which arguably could alter the law's current approach towards the criminal liability of addicted defendants. In this book, an overview of the different ways of conceptualising addiction is provided, before applying this knowledge onto both the legal framework of Dutch criminal law, and to more universal legal concepts. As such, the compatibility of concepts such as intent, premeditation, insanity, diminished responsibility and prior fault, with potentially impaired capacities stemming from addiction, is critically examined. After assessing the 'law in the books', the second half of the book contains an evaluation of the 'law in action'. This encompasses the role of addiction in case files, the presence of neuroscientific information in cases of addicted defendants, its influence on legal decision-making, and experiential accounts of legal professionals. Combining normative, comparative and experimental designs, the author does not only analyse some of the complexities of addiction in the context of criminal justice, but also contributes to the growing practice of interdisciplinary and empirical (neuro)legal research. .

The Criminal Justice System of the Netherlands offers an introduction to our fascinating legal system from a criminal law angle. The book consists of four parts. Coffeeshops are the most famous example of Dutch tolerance. But in fact, these cannabis distributors are highly regulated. Coffeeshops are permitted to break the law, but not the rules. Grotius wrote the 'Remonstrantie' around 1615 at the request of the States of Holland, to define the conditions under which Jews were to be admitted to the Dutch Republic. At that time, he was already an internationally recognized legal expert in civic and canonic law. The position taken by Grotius with respect to the admission of the Jews was strongly connected with the religious and political tensions existing in the Dutch Republic of the early 17th century. The 'Remonstrantie' shows how Grotius's views evolved within the confines of the philosophical and religious concepts of his time. It is an example of tolerance within political limits, analyzed by the author David Kromhout and made accessible through a modern translation.

Improving the quality of environmental law is high on the agenda of both the European Union and its Member States. In the Netherlands, there has been a series of changes of law in order to simplify and improve the complex and fragmented system of environmental law. However, the improvement of sectoral legislation has not led to the desired result. The Dutch legislature now considers a fundamental reform of environmental law necessary. One of the main goals is to achieve a coherent approach towards the physical environment in policy, decision-making and regulations. The Environment and Planning Act brings together 26 acts and about 120 governmental decrees in the area of spatiality and planning, infrastructure, nature and water, in order to create a single act for the physical environment. This book focuses on one of the key instruments of environmental law, the environmental permit. The integration of sectoral environmental permit systems is a way to simplify and speed up decision-making procedures for the authorisation of activities affecting the physical environment. The goal is to introduce a fully integrated environmental permit system. This means not only procedural integration of sectoral permitting systems but also substantive integration of the various assessment criteria. This concept of integrated environmental permitting has generated a great deal of discussion in the Netherlands

Asylum legal aid lawyers are under continuous public scrutiny. On the one hand, these lawyers are portrayed as being solely motivated by profit. On the other hand, they are depicted as leftist activists frustrating the legal system. When assisting their asylum seeking clients under the state's legal aid scheme, lawyers need to balance the client's interest, the public interest in the administration of justice and their own interest in profit or survival. The current book examines this balancing act and explores the role of the institutional context. It does so by studying the decision making of asylum legal aid lawyers in the Netherlands and England in respect of two ethical issues: `time vs. money' and `hopeless cases'.
