This collection of essays treats a topic that has scarcely been approached in the literature on Hebrew and Hebraism in the early modern period. In the seventeenth century, Christians, especially Protestants, studied the Mishnah alongside a host of Jewish commentaries in order to reconstruct Jewish culture, history, and ritual, shedding new light on the world of the Old and New Testaments. Their work was also inextricably dependent upon the vigorous Mishnaic studies of early modern Jewish communities. Both traditions, in a sense, culminated in the monumental production in six volumes of an edition and Latin translation of the Mishnah published by Guilielmus Surenhusius in Amsterdam between 1698 and 1703. Surenhusius gathered up more than a century's worth of Mishnaic studies by scholars from England, Germany, the Netherlands, and Sweden, as well as the commentaries of Maimonides and Obadiah of Bertinoro (c. 1455-c.1515), but this edition was also born out of the unique milieu of Amsterdam at the end of the seventeenth century, a place which offered possibilities for cross-cultural interactions between Jews and Christians. With Surenhusius's great volumes as an end point, the essays presented here discuss for the first time the multiple ways in which the canonical text of Jewish law, the Mishnah (c.200 CE), was studied by a variety of scholars, both Jewish and Christian, in early modern Europe. They tell the story of how the Mishnah generated an encounter between different cultures, faiths, and confessions that would prove to be enduringly influential for centuries to come.

An introductory essay by Lawrence H. Schiffman contextualizes the studies and points out the broader themes to which they relate.

David Novak is widely recognized as one of the most prominent Jewish thinkers in North America today and his most important contribution to philosophy has been his work on natural law. This book is an exploration of the shift in the content and context of that theory by reference to the metaphysical meaning that Novak ultimately assigns to reason. This change is then analyzed within the framework of Novak's covenantal theology and his developing view of redemption in particular. Through this examination, this book highlights the contribution of Novak's natural law theory to the continuing debate over the role of reason in Judaism.

Accounting for the Commandments in Medieval Judaism explores the discursive formation of the commandments as a generative matrix of Jewish thought and life in the posttalmudic period. Each study sheds light on how medieval Jews crafted the commandments out of theretofore underdetermined material. By systematizing, representing, or interrogating the amorphous category of commandment, medieval Jewish authors across both the Islamic and Christian spheres of influence sought to explain, justify, and characterize Israel's legal system, divine revelation, the cosmos, and even the divine order. This volume correlates bodies of knowledge-such as jurisprudence, philosophy, ethics, pietism, and kabbalah-that are normally treated in isolation into a single conversation about a shared constitutional concern.

Outside of the Bible, all of the known Near Eastern law collections were produced in the third to second millennia BCE, in cuneiform on clay tablets, and in major cities in Mesopotamia and in the Hittite Empire. None of the major sites in Syria that have yielded cuneiform tablets has borne even a fragment of a law collection, even though several have produced ample legal documentation. Excavations at Nuzi have also turned up numerous legal documents, but again, no law collection. Even Egypt has not yielded a collection of laws. As such, the biblical texts that scholars regularly identify as law collections represent the only "western, " non-cuneiform expressions of the genre in the ancient Near East, produced by societies not known for their political clout, and separated in time from "other" collections by centuries. Making a Case: The Practical Roots of Biblical Law challenges the long-held notion that Israelite and Judahite scribes either made use of "old" law collections or set out to produce law collections in the Near Eastern sense of the genre. Instead, what we call "biblical law" is closer in form and function to another, oft-neglected Mesopotamian genre: legal-pedagogical texts. During their education, Mesopotamian scribes studied a variety of legal-oriented school texts, including sample contracts, fictional cases, short sequences of laws, and legal phrasebooks. When biblical law is viewed in the context of these legal-pedagogical texts from Mesopotamia, its practical roots in a set of comparable legal exercises begin to emerge.

A scholar of law and religion uncovers a surprising origin story behind the idea of the separation of powers. The separation of powers is a bedrock of modern constitutionalism, but striking antecedents were developed centuries earlier, by Jewish scholars and rabbis of antiquity. Attending carefully to their seminal works and the historical milieu, David Flatto shows how a foundation of democratic rule was contemplated and justified long before liberal democracy was born. During the formative Second Temple and early rabbinic eras (the fourth century BCE to the third century CE), Jewish thinkers had to confront the nature of legal authority from the standpoint of the disempowered. Jews struggled against the idea that a legal authority stemming from God could reside in the hands of an imperious ruler (even a hypothetical Judaic monarch). Instead scholars and rabbis argued that such authority lay with independent courts and the law itself. Over time, they proposed various permutations of this ideal. Many of these envisioned distinct juridical and political powers, with a supreme law demarcating the respective jurisdictions of each sphere. Flatto explores key Second Temple and rabbinic writings-the Qumran scrolls; the philosophy and history of Philo and Josephus; the Mishnah, Tosefta, Midrash, and Talmud-to uncover these transformative notions of governance. The Crown and the Courts argues that by proclaiming the supremacy of law in the absence of power, postbiblical thinkers emphasized the centrality of law in the people's covenant with God, helping to revitalize Jewish life and establish allegiance to legal order.
