Few symbols in today's world are as laden and fraught as sharia-an Arabic-origin term referring to the straight path, the path God revealed for humans, the norms and rules guiding Muslims on that path, and Islamic law and normativity as enshrined in sacred texts or formal statute. This book examines the challenges of the implementation of Islamic law in Malaysia. Malaysia is a pertinent jurisdiction to explore such challenges given its global focus, colonial history and institutions, and the intersection of the Shari'ah and secularism/multiculturalism. The resultant implementation challenges are underpinned by three factors that make Malaysia an important jurisdiction for those interested in understanding the place of Islamic law in the global context. First, Malaysia is often considered as a model Islamic country. Islamic law is a source of law in Malaysia. The Islamic law legal system in Malaysia operates in parallel with a common law legal system. The two systems of law generally are in harmony with one another. Nevertheless, occasional cross-jurisdictional issues do arise, and when they do, the Malaysian judiciary has been quite efficient in solving them. The Malaysian experience in maintaining such harmony between the two legal systems provides lessons for a number of countries facing such challenges. Second, Malaysia has a developed Shari'ah court system that interprets and applies Islamic law predominantly based on the Shafi'i school of thought. While, for the most part, the approach has been successful, there have been times when the implementation of the law has raised concerns as to the compatibility of Islamic law with modern principles of human rights and common law-based values. Third, there have been cases where Islamic law implementation in Malaysia has gained global attention due to the potential for wider international implications. To do justice to this complex area, the book calls on scholars and practitioners who have the necessary expertise in Islamic law and its implementation. As such, this book provides lessons and direction for other countries that operate a dual system of secular and Islamic laws. .

This book examines the extraordinary nature of the power of preventive detention, which permits executive dispensation of the personal liberty of an individual on the mere apprehension that, if free and unfettered, he may commit acts prejudicial to national security or public order. In light of the extraordinary scope of this power, it, therefore, contends that the scope of the power should be confined to genuine emergencies threatening the life of the nation. Against the above background, this book sheds light on the fact that Article 149 of the Federal Constitution of Malaysia empowers the Parliament to enact preventive detention laws authorizing the executive branch of government to preventively detain individuals without the precondition of an emergency. Furthermore, the Constitution does not stipulate adequate safeguards for mitigating the harshness of preventive detention laws. This book makes it manifestly evident that the weaknesses of the constitutional provisions concerning preventive detention have enabled succeeding generations of executives in Malaysia to not only enact a series of preventive detention statues for arrogating to themselves wide powers concerning preventive detention but also to rely on them for arbitrarily detaining their political adversaries. Consequently, on the basis of this analysis, this book puts forward concrete recommendations for insertion in the Constitution detailed norms providing for legal limits on the wide power of the executive concerning preventive detention. The insertion of such norms would ensure the maintenance of a delicate balance between protecting national interests and, simultaneously, observing respect for an individual's right to protection from arbitrary deprivation of liberty.This book is useful for academics and students of comparative constitutional law, human rights and Asian law. The extensive law reform analysis undertaken in this book also greatly benefits the policy makers in Malaysia and the policy makers of constitutional polities facing similar problems with the issue of circumscribing the scope of the powers concerning preventive detention.

This book analyses the mobilisation of race, rights and the law in Malaysia. It examines the Indian community in Malaysia, a quiet minority which consists of the former Indian Tamil plantation labour community and the urban Indian middle-class. The first part of the book explores the role played by British colonial laws and policies during the British colonial period in Malaya, from the 1890s to 1956, in the construction of an Indian "race" in Malaya, the racialization of labour laws and policies and labour-based mobilisation culminated in the 1940s. The second part investigates the mobilisation trends of the Indian community from 1957 (at the onset of Independent Malaya) to 2018. It shows a gradual shift in the Indian community from a "quiet minority" into a mass mobilising collective or social movement, known as the Hindu Rights Action Force (HINDRAF), in 2007. The author shows that activist lawyers and Indian mobilisers played a crucial part in organizing a civil disobedience strategy of framing grievances as political rights and using the law as a site of contention in order to claim legal rights through strategic litigation. Highly interdisciplinary in nature, this book will be of interest to scholars and researchers examining the role of the law and rights in areas such as sociolegal studies, law and society scholarship, law and the postcolonial, social movement studies, migration and labour studies, Asian law and Southeast Asian Studies.

Karpal Singh, a tetraplegic following a road accident in Penang in 2005, literally 'died in the saddle' when his specially modified Toyota Alphard crashed into the back of a lorry on the North-South highway in the early hours of 17 April 2014. He was widely regarded as the best criminal and constitutional lawyer practising in Malaysia when he lost the game of chance everyone plays when they venture out onto a Malaysian road. One of Karpal's biggest achievements over the past 15 years was his steely defence of Malaysia's former Deputy Prime Minister Anwar Ibrahim on two charges of sodomy and one of corruption. Many in the international community, including members of the Inter-Parliamentary Union, believe the charges against Anwar were politically motivated and designed to prevent him from leading an opposition coalition to victory in the next two general elections. At the time of Karpal's death, Anwar had been sentenced to five years' imprisonment by the Court of Appeal in the Sodomy 11 case. In February 2014, Karpal was convicted of sedition in the High Court which, subject to the outcome of appeals, would have seen him lose his parliamentary seat as the MP for Bukit Gelugor. Against this background, Karpal privately believed Anwar would once again be returned to jail by the end of 2014. Karpal graduated from the University of Singapore in 1969, and was involved in state and federal politics since 1974. He was a fearless advocate for justice and a defender of human rights in Southeast Asia. He gained an international reputation for his defence of hundreds of people who faced the death penalty under Malaysia's Dangerous Drugs Act, among them Australian Kevin Barlow. 'Tim Donoghue's well-written biography of Karpal Singh, now in its second edition, records the life of a truly significant figure in Malaysian politics. It also records the personal side of the man. His account follows the incredible twists and turns of a larger than life character not only because of his involvement in politics, but also the law. Karpal's life reflected the modern history of Malaysia and the events that shaped it as a nation since Independence more than 50 years ago. Karpal Singh was very much an integral part of that history. It makes this biography relevant and important. On 9 January 2012, after a lengthy two-year trial, Anwar Ibrahim was acquitted of charges of sodomy against his 23-year-old aide, Mohd Saiful. The acquittal was a shock not only to Anwar-who expected to go to jail-but to most international observers who were convinced he would be found guilty. This book recounts both the first sodomy episode (1998-2004) and the Sodomy II trial (2008-2012). It then takes up the story after the acquittal, describing the events that led to the Malaysian Court of Appeal overturning the ruling in March 2014-convicting Anwar of the charge and sentencing him to five years' imprisonment-the final appeal against the conviction in the Federal Court of Malaysia In October 2014, and the guilty verdict that was finally delivered on 10 February 2015. Anwar is now in prison serving a five-year sentence. The 2014 conviction ruled him out of contesting a by-election for the parliamentary state seat of Kajang and plans to become the chief minister of Selangor. This book is a study of conceptions of Malay adat laws by several prominent colonial writers and some continuities, whose works are generally acknowledged and long regarded as pioneering and authoritative expositions of the subject. Some of the central problems explored in this study are as follows: how are Malay adat laws understood and portrayed by the authors?, what are some of the problems raised and possible factors which influence their selection?, what are the unquestioned assumptions and sources which condition their perceptions?, to what extent can their ideas be considered as accurate portrayals of adat law and what implications do they have not only on the image of the laws but Malay society and culture generally. By addressing these problems, this book hopes to contribute to a more accurate and balanced understanding of Malay laws.
