A case study in the textual architecture of the venerable legal and ethical tradition at the center of the Islamic experience, Shari'a Scripts is a work of historical anthropology focused on Yemen in the early twentieth century. While colonial regimes, late Ottoman reformers, and early nationalists wrought decisive changes to the legal status of the shari'a, significantly narrowing its sphere of relevance, the Zaydi school of jurisprudence, rooted in highland Yemen for a millennium, still held sway. Brinkley Messick uses the richly varied writings of the Yemeni past to offer a uniquely comprehensive view of the shari'a as a localized and lived phenomenon. Shari'a Scripts reads a wide spectrum of sources in search of a new historical-anthropological perspective on Islamic textual relations. Messick analyzes the shari'a as a local system of texts, distinguishing between theoretical or doctrinal juridical texts (or the "library") and those produced by the shari'a courts and notarial writers (termed the "archive"). Attending to textual form, he closely examines representative books of madrasa instruction; formal opinion-giving by muftis and imams; the structure of court judgments; and the drafting of contracts. Messick's intensive readings of texts are supplemented by retrospective ethnography and oral history based on extensive field research. Shari'a Scripts also ventures a major methodological contribution by confronting anthropology's longstanding reliance upon the observational and the colloquial, seeking to develop tools for the anthropologist as reader.

This book discusses sharecropping in the Yemen against the background of Islamic law and customary law. Sharecropping is particularly interesting in Islam since its basis (rent as a proportion of an unknown future harvest) is ostensibly inconsistent with the Islamic prohibition against transactions involving gharar (risk or uncertainty). The first half of the book analyses how Islamic theory views sharecropping and is based on a detailed analysis of key legal texts, while the second half focuses on sharecropping as it exists in practice in the Yemen. Textual sources (Islamic legal texts, contracts, pleas and fatwas are related throughout to Yemeni sharecropping in practice, a task not previously attempted, and the work has been written so as to be accessible both to social scientists and to Islamic legal specialists.

Islamic foundations (waqf, pl. awqaf) have been an integral part of Yemeni society both for managing private wealth and as a legal frame for charity and public infrastructure. This book focuses on four socially grounded fields of legal knowledge: fiqh, codification, individual waqf cases, and everyday waqf-related knowledge. It combines textual analysis with ethnography and seeks to understand how Islamic law is approached, used, produced, and validated in selected topics of waqf law where there are tensions between ideals and pragmatic rules. The study analyses central Zaydi fiqh works such as the Sharh al-azhar cluster, imamic decrees, fatwas, and waqf documents, mostly from Zaydi, northern Yemen.

"Yemenis have enjoyed greater freedom of expression since President Abdu Rabu Mansour Hadi took office in February 2012. His government has eased censorship and allowed more public debate. Yet, this newfound freedom has been tempered by a rising incidence of attacks on journalists, bloggers, and others seeking to exercise their right to free speech. In the past, journalists were targeted by state authorities, but now they face attack from other quarters, including non-state groups and powerful politicians. The attacks range from threats and harassment to physical assault and, in one case, murder. In "A Life-Threatening Career," Human Rights Watch details 20 attacks on journalists throughout Yemen that occurred between February 2012 and May 2013. Instead of responding to attacks on journalists with strong words and serious investigations, Hadi's government has largely failed even to condemn them. And some journalists have been prosecuted for criminal defamation before special courts. Human Rights Watch calls on the Yemeni government to condemn all attacks on the media, carry out prompt, thorough, and impartial investigations of such attacks, and bring those responsible to justice. Without such measures, the gains in free speech seen since Hadi took office will be cut short, as journalists are driven to self-censorship out of fear of further and more serious attacks."--Page 4 of cover.
