"La mise en œuvre de la Convention européenne des droits de l’homme, qui implique une interaction permanente entre les institutions européennes et nationales, peut induire de véritables rapports de force et nuire au dialogue attendu. La Cour européenne des droits de l’homme repousse en permanence les limites de l’interprétation de certains droits, entraînant le mécontentement, parfois la confrontation assumée des États membres. Or, le caractère discrétionnaire des choix dont ils disposent pour trouver les moyens appropriés d’exécution des arrêts, pouvant permettre de concilier leur droit interne avec les obligations conventionnelles, s’avère en pratique limité, le refus d’exécuter un arrêt ou son exécution imparfaite étant considérés comme une violation du texte conventionnel.
