For three decades Susan Aranoff and Rivka Haut have battled to free agunot, Orthodox Jewish women chained to dead marriages because their husbands refuse to give them a gett, a Jewish divorce. These chained women, citizens of modern Western democracies, may be civilly divorced, yet they are forced into rabbinic courts in their quest to obtain a gett. In these rabbinic courts women are subject to financial extortion, pressured to drop charges of domestic violence and paedophilia against their husbands and to concede custody and visitation rights to unfit fathers--all to induce their husbands to free them. Well-versed in the intricacies Jewish divorce law, Aranoff and Haut have counselled thousands of agunot and challenged the Orthodox rabbinate's inaction in the face of the injustices inflicted on these women. Aranoff and Haut take the reader into the rabbinic courts and their ancient, revered legal texts, onto the picket lines against recalcitrant husbands, into American civil divorce courts and legislatures that wrestle with this problem and into the lives of the victimized women and children. The agonies endured by agunot reveal the power of religious law over people's lives even when that law sharply conflicts with modern societies' moral and legal norms.

This collection of essays treats a topic that has scarcely been approached in the literature on Hebrew and Hebraism in the early modern period. In the seventeenth century, Christians, especially Protestants, studied the Mishnah alongside a host of Jewish commentaries in order to reconstruct Jewish culture, history, and ritual, shedding new light on the world of the Old and New Testaments. Their work was also inextricably dependent upon the vigorous Mishnaic studies of early modern Jewish communities. Both traditions, in a sense, culminated in the monumental production in six volumes of an edition and Latin translation of the Mishnah published by Guilielmus Surenhusius in Amsterdam between 1698 and 1703. Surenhusius gathered up more than a century's worth of Mishnaic studies by scholars from England, Germany, the Netherlands, and Sweden, as well as the commentaries of Maimonides and Obadiah of Bertinoro (c. 1455-c.1515), but this edition was also born out of the unique milieu of Amsterdam at the end of the seventeenth century, a place which offered possibilities for cross-cultural interactions between Jews and Christians. With Surenhusius's great volumes as an end point, the essays presented here discuss for the first time the multiple ways in which the canonical text of Jewish law, the Mishnah (c.200 CE), was studied by a variety of scholars, both Jewish and Christian, in early modern Europe. They tell the story of how the Mishnah generated an encounter between different cultures, faiths, and confessions that would prove to be enduringly influential for centuries to come.

Accounting for the Commandments in Medieval Judaism explores the discursive formation of the commandments as a generative matrix of Jewish thought and life in the posttalmudic period. Each study sheds light on how medieval Jews crafted the commandments out of theretofore underdetermined material. By systematizing, representing, or interrogating the amorphous category of commandment, medieval Jewish authors across both the Islamic and Christian spheres of influence sought to explain, justify, and characterize Israel's legal system, divine revelation, the cosmos, and even the divine order. This volume correlates bodies of knowledge-such as jurisprudence, philosophy, ethics, pietism, and kabbalah-that are normally treated in isolation into a single conversation about a shared constitutional concern.

David Novak is widely recognized as one of the most prominent Jewish thinkers in North America today and his most important contribution to philosophy has been his work on natural law. This book is an exploration of the shift in the content and context of that theory by reference to the metaphysical meaning that Novak ultimately assigns to reason. This change is then analyzed within the framework of Novak's covenantal theology and his developing view of redemption in particular. Through this examination, this book highlights the contribution of Novak's natural law theory to the continuing debate over the role of reason in Judaism.

The study of the laws of the Dead Sea Scrolls in the light of ancient rabbinic law, and vice versa, by a master of both corpora, sheds light on their interpretation, their history, and the spiritual stances they bespeak.
